terms of service | customer agreement

It is the clients responsibility to thoroughly review and understand these Terms of Service (T.o.S). The ability to comprehend the content of these T.o.S should be considered before contacting Crissiesaurus, as failure to abide by these T.o.S will result in the clients indefinite suspension of any and all services offered in past, present, or future. By paying for their order, the client thereby agrees to follow these T.o.S and fully understands that action, legal where necessary, will be taken if the client violates these T.o.S. The agreement may henceforth be referred to as a 'commission' or 'order'.

age restrictions

Clients must be 18 years or older to agree to these T.o.S, clients under the age of 18 will be turned away. By paying for your order, it is assumed that you, the client, are 18 years or older. If the client is found to be under the age of 18 after a commission has been ordered Crissiesaurus reserves the right to termiate the commission without refund.

workflow

Crissiesaurus' workflow may vary between orders, this means that orders may not be completed in the order of which they are placed nor at the same rate as another order. A rough estimate on timeframe for completion will be provided when the clients order is confirmed and reaffirmed once payment has been received. There are many factors which contribute to workflow and estimated timeframes, including but not limited to: availability, type and quantity of commission, delays, etc. Clients are encouraged to reach out regarding updates at anytime using the contact information provided in these T.o.S.

contact

Contact from the client may be initiated, maintained, and concluded through Crissiesaurus' email or social media. Crissiesaurus may at any time request to move initiated, maintained, or concluded contact to their email at [email protected] for the purpose of discussing details of a commission, potential commission, or delivery of a commission.

terms of service | content

As the artist, Crissiesaurus reserves the right to decline, withdraw, or terminate services for any reason. The artist reserves the right to determine what commissions they offer or accept at any time.

artificial intelligence

Artwork produced by Crissiesaurus is their own and created without the use of generative artifical intelligence (generative AI). It is acknowledged that Crissiesaurus may use a digital media program to create commissions, such progams are not considered generative AI.

digital media

Digital media commissions are delivered in a digital .png format via the primary means of communication upon completion. Other formats may be available if requested at time of commission and before such commission is completed.Digital media commissions will not be printed, framed, or delivered physically, personally or by parcel service to a physical address.

physical goods

Physical goods are commissions or pre-made goods which are printed, framed, or delivered physically, personally or by parcel service to a physical address.Physical goods are not delivered in a digital format.

terms of service | copyright & use

Crissiesaurus reserves the right to use commissioned work to promote their services, social media, or a working portfolio. Client or project credit will be distributed where due.All commissions will bear a watermark or signature for Crissiesaurus. Removal, distortion, or obstruction of this watermark or signature is prohibited.

intellectual property

The client retains all rights to any intellectual property which may be depicted in a commission.

personal use

Manipulation of the commission by the client or another artist is prohibited without written permission.The client is permitted to use the commission in print or on social media for non-commercial purposes.Redistribution of commissioned work without a written agreement is prohibited.

commercial use

Commercial works which require Crissiesaurus to relinquish these rights must sign a new contract explicitly detailing the rights and use of the commercial entity and Crissiesaurus.Without a written agreement, the client may not use the commission to represent or promote themselves or a commercial entity. This may include, but is not limited to use for the following: digital or physical products, digital or physical media, a business or company, a game (this includes RPs, ARPGs, or similar), social media, a website.

terms of service | pricing & payment

Commission prices prices are subject to change at Crissiesaurus' discretion. Prices may change based on the scope of a request.Once the terms of the commission have been accepted by all involved parites and payment has been made, such payment is non-negotiable and non-refundable.

rush fee

Crissiesaurus provides a rough estimate for commission completion during when a commission request is made. These estimates are not a deadline and may be adjusted at any time.If a client wants or needs a commission by a guaranteed date a request can be made at any time using the established method of contact. All rush requests must be determined before a commission has been accepted. Rush requests on a commission that has already been accepted may be rejected.The rush fee is typically +50% of the commission cost but may be adjusted based on client need and artist availability.

payment methods

Unless otherwise stated all prices are listed in United Stated Dollars (USD). Payment options include paypal, venmo, and ko-fi.

payment plans

Payment is expected to secure a commission, any work will not begin until payment has been received unless a payment plan has been established. Payment plans are available on a case by case basis for clients spending $200+ on a commission.The terms of a payment plan may be adjusted to fit business and client needs. The most common terms are as follows:
- 50% of the payment is due at the time of order to secure a commission and the remaining balance is due within 7 days of completion
- digital media or physical goods will not be sent or shipped until final payment has been received.
- remaining balance may be paid anytime prior to the orders completion
- failure to pay any remaining balance will result in forfeiture of prior payment and the completed order

refunds

While all payments are considered final and non-refundable, there is reasonable exception if Crissiesaurus determines they are unable to meet their obligations as an artist to complete the commission, such as:
- unable to complete the order in a timely manner or if a 'rush' deadline is missed
- physically or mentally unable to complete the order
- no longer wish to complete the order or work with the client
